Making a Claim

Making a claim for compensation for injuries sustained in an accident need not be complicated. By choosing the right solicitor the stress and strain of making a claim should be taken away from you. Your solicitor will deal with all of the correspondence with the other party and their insurers, will help you to gather all of the appropriate evidence including medical reports, and will advise you as to what sort of things you should be claiming for.

All good solicitors and insurance companies comply with the Personal Injury Protocol laid down by the Courts. This can often result in your claim being resolved without even having to start Court proceedings, or stepping into a Court room.

In those cases which cannot be resolved away from Court, your solicitors will fill in all of the Court paperwork and comply with all of the Court timetables.

Your solicitor will also keep you informed throughout the claim process and advise you of options available to you as the claim progresses.

N.B: Our solicitors will not touch your compensation. The negligent persons insurance will pick up the bill. This means it is in your solicitor’s interest to get your claim resolved as quickly as possible because they do not get paid until you recover your compensation.

It is important though that you remember that usually you must make your claim for compensation within three years of the date of the accident, or within three years of your eighteenth birthday. In some cases this three-year period is shortened to two years (for example if you were injured on board an aeroplane or boat, or sometimes if you were injured in an airport). Also, the longer you leave it to make your claim the more difficult it can be to gather the appropriate evidence together. You must therefore contact us as soon after the accident as possible in order to have the best chance of recovering the right compensation for you.
